In a move that will definitely test the local judicial system’s independence, MDC Alliance officials openly told Harare Magistrate Dennis Mangosi that they will no longer pursue for their removal from remand saying “let the court do what it pleases”.
This comes after Makomborero Haruziviishe, Denford Ngadziore and Allan Moyo’s legal representatives led by Human Rights lawyer Obey Shava made numerous applications for the trio to be removed from remand but the courts have not been forthcoming.
In this case, the three are being accused of having participated in a gathering with intent to promote public violence and the case has been going on and on since last year without trial.
The gesture has left the three with no option but to let the compromised judicial system to do whatever they want with them.
“When we appeared today (Wednesday) I had instructions from my client to tell the court that in their respective view it is only a fool who does the same thing over and over again and expect different results and to that extent I was instructed to advise the court that we were not going to make any further applications in trying to secure their freedom, in trying to remove them from remand,” Shava said.
“And as a messenger I duly delivered the message to the court that my clients are saying this is your show we are in your hands and we are not going to make any further application towards our individual liberties.”
Caught unawares by the trio’s sucker punch, the court felt that was a radical decision and urged lawyer Shava to make another application requesting for their release on the 5th of May 2021.
After consulting his clients, Shava said he will make the last application citing their intention to dump the legal channel of requesting for freedom.
“So, I shall make the application, i have liaised with my clients, I shall make the application as directed by the court and come back on the 5th of May 2021 and see how the proceedings will go.”
The regime has been using state apparatus including the courts to decimate the opposition members since the contentious 2018 elections.

MDC Alliance Youth Leader Obey Shava who is currently in custody on alleged criminal nuisance said the repressive gesture by the regime will not dampen the people’s spirit to bring a complete change in the country.
The vibrant youth leader was arrested on Monday for allegedly participating in a demonstration early this month.
His crime was singing protest songs with the lyrics “haikona kutamba neropa revakomana” and held placards inscribed “Free Mako, Free Joana, Ziyambi Must Go”.
The two are currently languishing in prison over laughable accusations.
