MDC Alliance legislator Joana Mamombe and Cecilia Chimbiri were on Tuesday granted ZW$10 000 bail each by High Court judge Justice Webster Chinamhora.
The two were arrested last week in Harare on allegations of using abusive and obscene language while addressing police officers.
The Harare West MP Mamombe and Chimbiri’s bail ruling comes after they were initially denied bail by Harare Magistrate Mambanje and were remanded in custody to 18 February.
On Monday, the duo’s bail hearing was postponed after State prosecutors requested more time to file a response to their submissions.
However, Justice Chinamhora overturned the lower court’s ruling on the two opposition female members.
The State failed to point out the propensity but used the pending case of abduction of the girls by State agents.
The record from the State witness, Assistant Inspector Ncube relates that there is no fear of the girls being given bail.
Arguments are that why would the State detain the duo for a level 7 case with an option of a fine if it were to be pursued.
Why then the State had to justify detention of the two for just an exchange of words in a dialogue.
The allegations were frivolous and are denied.
The defense Counsel further stressed that the duo were abiding religiously to their bail conditions and pray that the Statutory Instrument that was used be Repealed and has been used to further suffocate the liberty of the two Joana Mamombe and Cecilia Chimbiri.
The defense further argued that the police did not record a warned and cautioned statement.
The regional Magistrate misdirected the court by spliting one case of abduction into two.
In simple terms , the same case of Warren Park flash Demonstration is the same case of Abduction and torture of the girls which subsequently led the state to accuse the girls ,Joana Mamombe and Cecilia Chimbiri to be charged with publishing falsehood after they were relating their torture in hospital .
The High Court Judge granted them bail based on these arguments and ordered them to report to the law and Order every fortnight and reside at their current Address.
