Witness In Sikhala’s Case Fails to Testify, Defence Counsel Not Well

A State witness on Monday failed to testify against Citizens’ Coalition for Change Zengeza West Legislator Job Sikhala after the Defence counsel failed to attend court because he was unwell to stand trial.

Sikhala is facing charges of inciting public violence prior to the infamous July 31, 2020 demonstrations.

Munyaradzi Muputa, a State witness that was supposed to present evidence against Sikhala failed to testify after a representing Lawyer filed an application for postponement of the matter updating the court that the Defence Counsel representing Sikhala is unwell.

Lawyer P Mutsatsa who was representing Defence Counsel Harrison Nkomo said, Nkomo will not be available till the 5th of December due to his health condition.

“I am standing for the accused person and I am also standing in for the Defence Counsel. We are filing an Application for postponement of the matter, Nkomo the Defence Counsel is not feeling well he will be available on the 5th of December 2022,” said Mutsatsa.

State did not oppose the postponement.

“We do not oppose the postponement of the matter to the dates mentioned by the Defence since we cannot proceed in the absence of the core Defence Counsel,” said the State.

Harare Regional Magistrate Vongai Muchuchuti Guwuriro highlighted that she won’t be available on the proposed date but said she will be available on the 16th of December 2022 and then postponed the matter to December 16 at 0900.
