The High Court has stayed the trial proceedings of Citizen’s Coalition for Change Member of Parliament for Harare West Joana Mamombe and CCC member Cecilia Chimbiri’s case.
Mamombe and Chimbiri are charged with communicating falsehoods prejudicial to the State after they allegedly faked their abductions in May 2020.
The High Court Judge stayed their trial proceedings pending the hearing of the review application which challenges the dismissal for their application for discharge.
The duo’s review will be heard on 17 November 2022.
According to the state papers, “The trial proceedings against the aplicants in case No. CRB ACC 45-46/20 in the Magistrate Court be and is hereby stayed pending the determination of the application for review in HC 6207/22…”
“The application for the review shall be heard on 17 November 2022 at 10.00am.”
Mamombe and Chimbiri applied for discharge after the state closed its case last month through their lawyer Alec Muchadehama who submitted that the state failed to prove a prima facie against his clients.
The duo were are arrested together with their friend, Netsai Marova who skipped the country last year with an arrest warrant issued against her.
Mamombe and Chimbiri instesed that they were arrested at a roadblock near Harare Show Grounds by alleged state officers, who tortured them before dumping the trio at a shopping centre near Bindura.
Medical affidavits proved that they were brutally assaulted to an extent that they were unable to walk and spent several days in hospital before they were discharged.
