Mhlanga Bail Bid Rejected Again

The Harare Magistrates Court has once again denied bail to journalist Blessed Mhlanga of Heart and Soul Television, stating concerns that upon release, there’s no guarantee that he will stand for trial.

 

Delivering his ruling today, Magistrate Donald Ndirowei stated that the court is not obligated to follow press releases issued by the National Prosecuting Authority of Zimbabwe (NPA) or the precedent set in the Owen Madondo’s (DJ Ollah 7) case.

“This court is not bound by the press releases from the NPA, neither is it bound by the Owen Madondo’s case and if the accused is granted bail there’s no guarantee that he will stand for trial,” Magistrate Ndirowei stated in his ruling.

“This bail application lacks merit and is therefore dismissed.” He added.

 

Mhlanga’s legal team had appealed to the Magistrates Court after Justice Gibson Mandaza previously upheld the lower court’s initial decision to deny bail.

 

Justice Mandaza had stated potential interference with investigations and witnesses as reasons for the continued detention.

The court also dismissed arguments from the defense that the charges against Mhlanga infringed upon press freedom, adding that journalistic practices must adhere to legal frameworks.

 

The charges against Mhlanga originate from allegations of inciting public violence through the transmission of information.

 

These allegations arose after HStv covered press conferences held by war veteran Blessed Geza.

 

This latest ruling marks another setback for Mhlanga and his legal team, who have been persistent in their efforts to secure his release.
