Wicknell Chivayo wins court case against ZPC

Controversial businessman and Intratek Zimbabwe managing  director Wicknell Chivayo has won his court case against the Zimbabwe Power company (ZPC).

Chivayo and his company had been embroiled in a protracted legal battle with the state owned power firm over  the controversial  US$172,8 million contract for the construction of the 100MW solar power plant in Gwanda.

The Zimbabwe Power Company (ZPC) entered into a contractual agreement with Intratek Zimbabwe for  the Gwanda solar power plant in 2015 before the deal was halted after the firm had failed to commence operations despite being paid US$5 million for site establishment works, ground clearance and construction access roads at the project site.

Chivayo was then hauled before the courts facing charges of fraud before being acquitted.

The intratek boss sued ZPC US$22 million in damages for defamation arguing that his company’s reputation had been damaged by the ZPC scandal which saw him losing out on lucrative business deals.

The High Court ruled in favour of Chivayo who will now get US$22 million in damages from Zimbabwe Power Company (ZPC).

The court also ruled that the deal between the two parties is valid and binding paving the way for the resumption of the renewable energy project.
