Two Mufakose High 1 students were dragged to court on Thursday, for contravening section 35(a) of the Zimbabwe School Examinations Council (ZIMSEC) Act 25:18, and were charged with unlawful access to any examination material.
Beloved Rex Chidhakwa (19) and Tinashe Shambi (19) appeared before Harare Magistrate Tafadzwa Miti.
The duo was granted bail of $ZWL 15 000 each and will be back in court on November 28.
According to the state, on the 18th day of October 2022, (accused 1) Chidhakwa sat for the Ordinary Level Mathematics paper 1 examination scheduled for the morning session, Zvikomborero Blessing Gomera was invigilating.
Chidhakwa was in possession of his cell phone, iPhone 6S and he did not declare or surrender it to the invigilator regardless an announcement to do so by the invigilator on entrance into the examination room.
During the course of the examination, Gomera observed the accused scrolling on his phone which was switched on.
Gomera recovered the iPhone 6s cell phone and took it together with the accused 1 to the school Headmaster David Vurayayi where she reported the matter. The iPhone was viewed and it was discovered that it contained scanned copies of the Ordinary level November 2022 Mathematics paper code number 4004/1 which was being written the same day and pictures of the proposed answers.
Matter was reported to the police and Chidhakwa implicated (accused 2) Shambi as the source of the examination material which he said was sent to his WhatsApp account number 0718 089 936 from Chidhakwa’s WhatsApp account number 0782 348604. Chidhakwa’s phone containing scanned copies of the mathematics paper 1 code number 4004/1 and pictures of proposed answers can be produced in court as exhibit.
Shambi was arrested and his Samsung A10S was recovered. His cell phone was viewed and it was discovered that it contained the same examination material.

Conduct of the accused persons was unlawful.
