50/50 Rights Over Minor Guardianship

President Emmerson Mnangagwa has signed the Guardianship of Minors Amendment Act into law, the law amended the Guardianship Act by giving both the father and mother of a child equal rights in making decisions that affect the child.

Mnangagwa signed the Guardianship of Minors Amendment Act into law last week, the Bill had been passed by Parliament in March.

The previous Act gave the father the final say on the child welfare and any other decision making, although he has supposed to consult before making the final decision.
A minor in Zimbabwean Constitution is any person under the age of 18 and some of the rights that are given to both parents by the new Law include health, education needs, financial security, religious upbringing, welfare needs and many others.
Governments move to give equal rights to both parents of the child aligns with the Constitution of Zimbabwe which gives first preference to child’s interest.
Section 81 (2) of the Zimbabwean Constitution provides that, “A child’s best interests are paramount in every matter concerning the child”.
