Moana’s father wins burial case, Judge says there was nothing wrong with issued burial oder

High Court judge Justice Pisirai Kwenda on Friday granted the late socialite Moana’s father Ishmael Amuli the right to bury her stating that he has the constitutional right to the burial oder.

The Burial is now set for Warren Hills at 1pm tomorrow.

As per her mothers request the body will still pass through Highfield in casket while, the casket is to be discarded at cemetery.

This follows disagreements between the two families while fighting for her body and burial procedure.

Moana’s father wanted her late daughter to be buried the Islamic way at the muslims section in Warren Hills Cementry.

While her and mother Yolander Kuvaoga wanted a celebrity send off at Zororo Memorial Park in Chitungwiza preferred by Kuvaoga.

Kuvaonga then approached the courts seeking cancellation of a burial oder which had granted Amuli the right to bury her daughter the Islamic way.

Passing the burial Judgement on Friday at the High Court judge Justice Pisirai Kwenda said , “ I conclude that the burial order was correctly issued and there’s nothing wrong with its issuance it remains valid.”

“It’s correct that deceased was born to the Amuli family and it’s a constitutional value that cannot be taken away she identified with the customs of her family.”

Following her death Moana’s father in a video clip interview said that he was not speaking with his daughter , there were not in good terms .

However , he is the one who took care of her from a tender age with the help of her step mother.

Judge Kwenda said , “ Applicant was absent from her daughter’s life from her infancy and it was Amuli’s constitutional right to choose. “

“A year that she didn’t speak to her father is nothing compared with the 25 years they were in good books.”

Moana passed away on November 8 in a horrific accident that also claimed the lives of Harare socialite Genius “Ginimbi” Kadungure, Malawian fugitive Limumba Karim and Mozambican model Alichia Adams.
