It appears the legitimacy of the current President and First Secretary of ZANU PF Cde Emmerson Dambudzo Mnangagwa will continue to attract criticisms from both within and outside the party after it emerged that the late First Secretary of the party Cde Robert Gabriel Mugabe did not resign from his party position.

Mugabe died in 2019, two years after he was forced to resign under the guise of Operation Restore Legacy – a military operation.
The military induced operation cleared path for Cde Mnangagwa to lead both the country and ZANU PF as President and First Secretary of the party respectively.
Mnangagwa’s rise to power has since been criticized by his opponents from both the party and outside.
Speaking to TechMag TV recently, Goodman Tamuona Musariri who is the District Chairman for ZANU PF’s Masimba Political District in Ward 14 of Mazowe said the central committee caucus of 19 November 2017 which gave birth to the current party leadership was fraudulent.
Musarira added that the meeting which was orchestrated by Ambassador Christopher Mutsvangwa – who was a non central committee member at the material time was unlawful and unconstitutional according to the party’s legal document.
In another interesting revelation, Article 1 of the ZANU PF Constitution states that, “There shall be a seal of the Party which shall be kept by the President and First Secretary and shall be used under the direction and control of the President of the party,” Article 1 (3) page 7 reveals.
According to Musariri, Mugabe, the seal holder, was under house arrest during the central committee caucus.
His absence during the hurriedly organised meeting made it null and void.
“Putting Mugabe under house arrest did not take away the SEAL of ZANU PF from Mugabe (MHSRIP). Mugabe still holds the ZANU PF SEAL in his grave as he never resigned from ZANU PF as President and First Secretary but from his position as President of the Republic of Zimbabwe meaning the Government / Executive under seperation of powers as it is Parliament that announced the resignation which Mugabe still claimed was Voidable and or null and void,” said Musariri.
He added that the nullity of the meeting was supported by gross misrepresentation through false pretence that Operation Restore Legacy was only targeting Criminals Surrounding the President when in actual fact they knew an unlawful Central Committee Caucus never sanctioned by the sole holder of the Party Seal.
“Party Seal is like a Royal SEAL of the British crown especially under the ONE CENTRE OF POWER which ZANU PF had adopted. The Party President would never have been said to be ABSENT when he was only under House Arrest of a Coup on top of that matter,” Musariri said.
“Absence of Mugabe the sole holder of the SEAL could thus never be in the ABSTRACT but was supposed to be a qualified ABSENCE where upon Mugabe would formally have delegated the presiding of any Cenral Committee in the Ascendancy or protocol given in the ZANU PF Constitution.”
“Therefore it is clear that the EXCLUSIVE POWER to convene or preside either the Central Committee or Congress or Politburo Sessions lied on the holder of the Party Seal who is the late Robert Mugabe MHSRIP.”
Meanwhile, Musariri who is on remand for undermining authority of or insulting president has on Monday been remanded again to 16 November.
