The ruling party, ZANU PF’s rushed central committee session held on 19 November 2017 which promoted the current President Emmerson Dambudzo to the first Secretary of the party’s position was not competent or well represented, a ZANU PF official has revealed.

Goodman Tamuona Musariri who is the District Chairman for ZANUPF’s Masimba Political District in Ward 14 of Mazowe South Constituency since 2013 is currently coercing individuals and organizations to fund his impending court case against the rise of the current ZANU PF First Secretary and President of the Republic of Zimbabwe His Excellence Cde Mnangagwa.
President Mnangagwa’s ascendancy to power which involved the army has since November 2017 come under scrutiny.
The November events which abruptly ended the former president who is now late Robert Mugabe’s more than three decades tenure brought high expectations among locals and internationals.
It gave birth to a new era popularly known as The New Dispensation under the leadership of Mnangagwa who previously had been kicked out of the party few weeks before the army initiated take over.
E.D was fired for dishonesty, displaying little probity and for lacking integrity which was read on ZBC TV by party’s spokesperson Simon Khaya Moyo then.
A lot has been said about his ascendancy to power – a coup not a coup. Some would call it a soft coup.
The events happened so quickly like a lightning flash that some never thoroughly followed on how ED as popular known ended up being the first Secretary of the party and later president of the republic of Zimbabwe.
Speaking to Musariri in an exclusive interview , he said President Mnangagwa’s rise to the first Secretary’s position was unconstitutional according to the party’s legal document.
“A Central Committee has no jurisdiction over membership of any Office bearer of Congress. All Central Committee members are elected by Congress.
President is elected by Congress. V. Ps are not ELECTED but are appointed at the pleasure and mercy of the President
At November 2017 ZANU PF had ONE CENTRE OF POWER around the President who was the sole custodian of the Party SEAL. No central Committee would take place without Authority of the President.
Formal delegation would be by the express Authority of the President.”
Musariri added that Mugabe (former and late President) was under house arrest when the ‘coup’ was in motion but was NOT absent as President and First Secretary of ZANU PF. The office of the President was forever present.
“If ever a vacancy would arise in the office of ZANU PF President, the Secretary for Admin would convoke Section 26 that is Extraordinary Congress to nominate and elect a President.”
“The two said VPs were appointed outside Congress to serve at the pleasure and mercy of the President not Congress. Therefore, the expulsion of then V.P E. D remains valid forever!
According to the party’s constitution, a Central Committee can’t reinstate, expel, co-opt, elect nor recall any office bearer of Congress which includes the same Central Committee members.
“V. Ps are appointed against probity, ability, Integrity and against the UNITY ACCORD of 1987. An APPOINTED V.P appointed outside congress can’t succeed an ELECTED President of Congress. POWER is not transmitted by APPOINTMENT but by ELECTION,” Musariri added.
Musariri who openly share his allegiance to the current Vice President retired General Constantino Chiwenga said that E.D was imposed by an unsanctioned Central Committee Caucus of 19 November 2017 which went on to issue ULTRA VIRES resolutions that are ‘null and void forever’.
“Mugabe only resigned from his position as President of the Republic of Zimbabwe or Government but never resigned as President and First Secretary of ZANU PF the position which he held until his DEATH,” he said.
“I am going to quote Section 38 as is so that we both qualify that there was no competent Central Committee Session held on 19 November 2017.
Which makes EVERYTHING null and void!!
Imagine that Ambassador Mutsvangwa who was not a Central Committee Member at the material time spearheaded and orchestrated the Central Committee Caucus and that he was the one moving the controversial motions of expulsions, recall and reinstatements etc?? He added.
Chris Mutsvangwa was not a member of ZANU PF then after he was fired from the party for undermining the authority of the then president.
Furthermore, he likened the central committee and the congress to the High Court and Supreme Court respectively.
“Central Committee is termed the Highest decision-making organ of the party. The Congress is termed the Supreme Organ of the Party.”
“With the election of all Central Committee members and President being EXCLUSIVE to the Congress. Central Committee does not have any Jurisdiction over any human resources function of an office bearer of Congress.”
“The ZANU PF Constitution since 2014, was made in such a manner that an Appointed V.P is an Ex Officio member of the Congress just like how a Provincial Chairman is an Ex Officio member of the Central Committee. Only an Extraordinary Congress can replace a ZANU PF President and First Secretary should a vacancy arise.”
“The ZANU PF Constitution has no provision for recalling a Party President whatsoever. Mugabe would solely convene and preside Central Committees and Congresses and every V.P and at some instance the Chairman could only do so by delegation.”
“The Secretary for Administration can convene an Extraordinary Congress if a vacancy arises in the office of the ZANU PF President and First Secretary.”
“Thus appointed V. Ps by the President outside Congress and the President and First Secretary of ZANU PF are UNLIKE TERMS in the SUCCESSION DEBATE. Both V.P Mphoko and E.D remained mere PLACEHOLDERS of the UNITY ACCORD!!
Musarira is currently on remand after he challenged the ascendancy of president Mnangagwa to presidency through an alleged unsanctioned and unlawful central committee caucus of 19 November 2017 orchestrated by ambassador Chris Mutsvangwa – who was a non-central committee member at the material time.
