The President of the Republic of Zimbabwe is certainly smiling having passed AMMENDMENT NO.2 which sailed through.
65 Senators voted YES whilst 10 voted NO for Constitutional Amendment Number No.2 The Bill will now be presented to the Head of State President ED Mnangagwa for assent.
Senators were due to vote on Constitutional Amendment Bill (No. 2).Critics say It is a disguised amendment of section 328 of the Constitution which is illegal because it can only be amended through a referendum. This BSR explains the section 328 defence mechanism:”
” CONSTITUTION is the Supreme Law of Zimbabwe. The Chief Justice must do the right thing and not dribble the law. ”said a follower on twitter of @WMagaisa.
One twitter said ”Others felt it was raping the citizenry with an amendment not wanted by the people.Another school of thought said, ED and Zanu PF really feel invincible right now but when the collapse starts it will be messy. Repealing and undoing of their illegality will be spontaneous and instant. Their empires will fold and sink into abyss, they will be a joke on everyone’s lips.”
A consortium of Bulawayo based lawyers led by Ncube and Partners is preparing to challenge the passing on of the Constitution of Zimbabwe Amendment (No. 1) Bill in parliament.
As a result, the clauses which have been changed and added to the Bill have not been properly passed by parliament. This will remain so no matter how many MPs voted for the Bill in its final reading on 20 April. “https://googleads.g.doubleclick.net/pagead/ads?client=ca-pub-5605172818332652&output=html&h=280&adk=82036120&adf=681418589&pi=t.aa~a.2454381133~i.9~rp.4&w=670&fwrn=4&fwrnh=100&lmt=1619524868&num_ads=1&rafmt=1&armr=3&sem=mc&pwprc=7406986751&psa=1&ad_type=text_image&format=670×280&url=https%3A%2F%2Fwww.techmag.tv%2Fbulawayo-lawyers-derail-mnangagwas-constitutional-ammendments-2%2F&flash=0&fwr=0&pra=3&rh=168&rw=670&rpe=1&resp_fmts=3&wgl=1&fa=27&uach=WyJXaW5kb3dzIiwiMTAuMCIsIng4NiIsIiIsIjkwLjAuNDQzMC45MyIsW11d&dt=1619524867916&bpp=3&bdt=10215&idt=3&shv=r20210422&cbv=r20190131&ptt=9&saldr=aa&abxe=1&cookie=ID%3D9563c850c52f5426-229b1dbe3fa700ea%3AT%3D1617103945%3ART%3D1617103945%3AS%3DALNI_MbATqtbQAKJ-EPhezpMNxntcLIi-Q&prev_fmts=0x0%2C670x280&nras=3&correlator=2376104045764&frm=20&pv=1&ga_vid=1530202867.1619524858&ga_sid=1619524858&ga_hid=1406831620&ga_fc=0&u_tz=120&u_his=3&u_java=0&u_h=768&u_w=1366&u_ah=728&u_aw=1366&u_cd=24&u_nplug=3&u_nmime=4&adx=165&ady=1732&biw=1349&bih=568&scr_x=0&scr_y=0&eid=21066431&oid=3&pvsid=3212262758643050&pem=614&ref=https%3A%2F%2Fwww.techmag.tv%2F&eae=0&fc=1408&brdim=0%2C0%2C0%2C0%2C1366%2C0%2C1366%2C728%2C1366%2C568&vis=1&rsz=%7C%7Cs%7C&abl=NS&fu=128&bc=31&ifi=3&uci=a!3&btvi=2&fsb=1&xpc=tIwbdl2CWz&p=https%3A//www.techmag.tv&dtd=94
This move will potentially derail Chief Justice Luke Malaba’s controversial plan to extend his tenure, saying the move violates the constitution. The extension plan is linked to President Emmerson Mnangagwa’s 2023 re-election bid. Malaba seemed on course for a politically and constitutionally problematic extension of his tenure after high-level official interventions and the passing of the Bill, which is now awaiting Mnangagwa’s assent.
Constitutional Amendment (No.1) Bill, among other things, seeks to allow the President to appoint the Chief Justice, Deputy Chief Justice and Judge President without subjecting them to the open selection process and public interviews.https://googleads.g.doubleclick.net/pagead/ads?client=ca-pub-5605172818332652&output=html&h=280&adk=82036120&adf=2294557178&pi=t.aa~a.2454381133~i.13~rp.4&w=670&fwrn=4&fwrnh=100&lmt=1619524868&num_ads=1&rafmt=1&armr=3&sem=mc&pwprc=7406986751&psa=1&ad_type=text_image&format=670×280&url=https%3A%2F%2Fwww.techmag.tv%2Fbulawayo-lawyers-derail-mnangagwas-constitutional-ammendments-2%2F&flash=0&fwr=0&pra=3&rh=168&rw=670&rpe=1&resp_fmts=3&wgl=1&fa=27&uach=WyJXaW5kb3dzIiwiMTAuMCIsIng4NiIsIiIsIjkwLjAuNDQzMC45MyIsW11d&dt=1619524867929&bpp=2&bdt=10227&idt=2&shv=r20210422&cbv=r20190131&ptt=9&saldr=aa&abxe=1&cookie=ID%3D9563c850c52f5426-229b1dbe3fa700ea%3AT%3D1617103945%3ART%3D1617103945%3AS%3DALNI_MbATqtbQAKJ-EPhezpMNxntcLIi-Q&prev_fmts=0x0%2C670x280%2C670x280&nras=4&correlator=2376104045764&frm=20&pv=1&ga_vid=1530202867.1619524858&ga_sid=1619524858&ga_hid=1406831620&ga_fc=0&u_tz=120&u_his=3&u_java=0&u_h=768&u_w=1366&u_ah=728&u_aw=1366&u_cd=24&u_nplug=3&u_nmime=4&adx=165&ady=2029&biw=1349&bih=568&scr_x=0&scr_y=0&eid=21066431&oid=3&pvsid=3212262758643050&pem=614&ref=https%3A%2F%2Fwww.techmag.tv%2F&eae=0&fc=1408&brdim=0%2C0%2C0%2C0%2C1366%2C0%2C1366%2C728%2C1366%2C568&vis=1&rsz=%7C%7Cs%7C&abl=NS&cms=2&fu=128&bc=31&ifi=4&uci=a!4&btvi=3&fsb=1&xpc=fKNp4sNy0n&p=https%3A//www.techmag.tv&dtd=530
This will allow Mnangagwa to retain Malaba at the helm of the judiciary after the approval of Constitutional Amendment (No.2) Bill, which is set to be railroaded through parliament, to enable Malaba to serve when he is over 70.
AT a time when President Emmerson Mnangagwa and Chief Justice Luke Malaba thought their authoritarian consolidation agenda through roughshod constitutional amendments to ensure their 2023 election plan remains intact was on track – steaming ahead unstoppably – lawyers have taken a bold move to derail the runaway train of dictatorship.https://googleads.g.doubleclick.net/pagead/ads?client=ca-pub-5605172818332652&output=html&h=280&adk=82036120&adf=1747523175&pi=t.aa~a.2454381133~i.17~rp.4&w=670&fwrn=4&fwrnh=100&lmt=1619524869&num_ads=1&rafmt=1&armr=3&sem=mc&pwprc=7406986751&psa=1&ad_type=text_image&format=670×280&url=https%3A%2F%2Fwww.techmag.tv%2Fbulawayo-lawyers-derail-mnangagwas-constitutional-ammendments-2%2F&flash=0&fwr=0&pra=3&rh=168&rw=670&rpe=1&resp_fmts=3&wgl=1&fa=27&uach=WyJXaW5kb3dzIiwiMTAuMCIsIng4NiIsIiIsIjkwLjAuNDQzMC45MyIsW11d&dt=1619524867935&bpp=2&bdt=10233&idt=2&shv=r20210422&cbv=r20190131&ptt=9&saldr=aa&abxe=1&cookie=ID%3D9563c850c52f5426-229b1dbe3fa700ea%3AT%3D1617103945%3ART%3D1617103945%3AS%3DALNI_MbATqtbQAKJ-EPhezpMNxntcLIi-Q&prev_fmts=0x0%2C670x280%2C670x280%2C670x280&nras=5&correlator=2376104045764&frm=20&pv=1&ga_vid=1530202867.1619524858&ga_sid=1619524858&ga_hid=1406831620&ga_fc=0&u_tz=120&u_his=3&u_java=0&u_h=768&u_w=1366&u_ah=728&u_aw=1366&u_cd=24&u_nplug=3&u_nmime=4&adx=165&ady=2019&biw=1349&bih=568&scr_x=0&scr_y=0&eid=21066431&oid=3&pvsid=3212262758643050&pem=614&ref=https%3A%2F%2Fwww.techmag.tv%2F&eae=0&fc=1408&brdim=0%2C0%2C0%2C0%2C1366%2C0%2C1366%2C728%2C1366%2C568&vis=1&rsz=%7C%7Cs%7C&abl=NS&fu=128&bc=31&ifi=5&uci=a!5&btvi=4&fsb=1&xpc=ysxPEFvPNJ&p=https%3A//www.techmag.tv&dtd=1354
